SSO National Environmental Policy Act (NEPA) Categorical Exclusion Determination Listing 
 

The Department of Energy NEPA Implementing Regulations at 10 CFR 1021, Appendix B to Subpart D, contain a list of classes of actions that are categorically excluded from the need to prepare an environmental assessment or environmental impact statement. 

 

Under the new policy announced in ‘‘NEPA Process Transparency and Openness’’ (October 2, 2009, memorandum from Deputy Secretary Daniel B. Poneman to Heads of Departmental Elements), SSO is required document and post online all categorical exclusion determinations involving classes of actions listed in Appendix B. 

 

The proposed activities meet the categorical exclusion eligibility criteria identified in 10 CFR 1021 Subpart D, Section 1021.140, Application of Categorical Exclusions (Classes of Actions that Normally Do Not Require an EA or an EIS); and as identified in 10 CFR 1021 Subpart D, Appendix B(1)-(4), Conditions That Are Integral Elements of the Classes of Actions in Appendix B.  

 

The actions listed here do not threaten a violation of applicable statutory, regulatory, or permit requirements for environment, safety, and health, including requirements of DOE and/or Executive Orders.
